It’s time Jeremy Sear sued Andrew Landeryou

Disgusting web filth Andrew Landeryou used to break the big gossip stories from the right wing of the Labor party in Victoria (or more accurately, he did so on one occasion). Then, naturally, everyone stayed well clear of the declared bankrupt and one time fugitive. The completely unemployable Landeryou is now left pursuing imagined enemies, like Jeremy Sear.

Landeryou pursues an irrational stalker like obsession with small time blogger Jeremy Sear, however today things hit an all time low. In this “article” Landeryou posts a photo of Sear with the words “Jeremy Sear: Criminal Barrister” plastered across the top. The article in question releases personal details about Sear’s family, including his mother’s home telephone number.

Australia has laws against these things. These sorts of actions constitute stalking and defamation, plain and simple. Sear dismisses these actions as little more than irritations, and normally such thick skinned behavior should be applauded. But the fact of the matter is that Landeryou will eventually pursue others in this disgusting and abusive manner, other bloggers who may not be as qualified or with as clear cut a case against Landeryou as Jeremy Sear.

As such, I call upon Jeremy Sear to pursue legal action against Andrew Landeryou. It’s long since time this bastard felt the legal consequences of his actions. I’m not rich, but if money’s a problem I will happily chip in.

I tend to think that you make a number of mistaken assumptions in this post and I invite you to read my thoughts on this matter posted

For no matter how despicable you may think that Landeryou’s actions are (and even I denounce the publication of Sear’s parents address and phone number) the fact remains that what he has written would probably not be “bad enough” to constitute defamation as our law defines it. For instance calling Sear a “criminal barrister” could well be defended on the basis that he is a barrister who acts in criminal matters, and there fore calling him “criminal barrister” is no slur at all. And as such not defamation. I am not an expert but I have been threatened with a writ by Sear in the past (over a picture of his cat that I published in my blog would you believe) and he does run the risk of a complaint to the Bar Association, should he use his position as a barrister to intimidate any of his critics.
Finally he is hardly the small fry that he tries to portray himself as; according to Technorati there are 292 links to his blog in 121 Blogger’s blog rolls. And 708 links to his blogs in people’s posts. He is a player and yet he constantly denies that he is anything more than “a minor lefty blogspot blogger”.

Landeryou has quietly and disingenuously changed the image to insert a little “hat” that wasn’t in it last night. The hat changes the text so it reads “criminal barrister” (well, arguably), instead of “barrister - CRIMINAL”, which is how it read last night without the little mark.

So Landeryou did back down in the face of proposed action. He just did it in the most pathetically minimal way imaginable.

aActually scott I am probably more aware of the legal situation than you are in this case having had the first had experiance of Sear’s endless threats by implication that he would sue me.In fact I am pretty sure that he is actually breathing a sigh of relief that Landeryou has made that little change to the graphic so that he could legitimately claim that the grounds for a writ no longer exist. Thus he couls claim that he has gone up to the brink and fought the good fight,without having to pay for a writ.

For some reason I would tend to side with a member of the Bar when it came to legal matters rather than a try-hard blogger whose only legal experience is on the receiving end of injunction orders. Call me crazy

Call me crazy My criticism of lefties who don’t know about the laws on defamation in this country was of course directed at Sear’s cheer squad and not at Sear himself. For your future information I have never been served with any court orders, or injunctions by either Sear, or any of his fellow travellers.
This is a man so well versed in the law that he seriously tried to convince me that he was the holder of the copy right for a Photo because he was its subject. Now I bet that even you would not trust your life and liberty to a member of the bar who would make such a fundamental error.

No, I told you I was the holder in copyright for that photograph that you were using without permission because I am. It is my photograph, even though (not because) I am the subject. I could easily prove it if it became necessary.

I made no “error” of law. You have no idea what you’re talking about.

And I note that, your “courage” bolstered by Landeryou’s outrageous campaign against me and my family, you’ve now restarted your own. Without any prompting from me. I thought we had a truce - you’d quit the personal attacks on me, and in return I would continue to ignore you.

Have you really nothing better to do with your time?

Jeremy we both know that I have been paying you very little attention apart from some wry comments on your stoush with Landeryou. In any case I do have better things to do with my time. But don’t try and fudge the truth about that photo because you only came to make the same claim that you do now AFTER I pointed out your error in law. If you give me permission I will happily publish the emails we exchanged in relation to that picture. :)
Now I have a brand new Blog and it is my intention not to clog it up with any discussion of you and your foibles.
In any Case, I offered the truce because you published my home Address, an aerial Photo and phone number in your “A Melbourne Video Gamer Blog” and I warned you then that the truce was dependant upon you keeping those who act in your name in check. They have continued to attack me and one of them has published my residential address… and you expect me to believe that you have fulfilled your side of the bargain?

But rest easy because if you look at my new site you will see that I have not transferred the majority of my posts that pertain to Boltwatch or yourself to my new “home” they can stay where they are because if I ‘archive’ them I get accused of trying to ”hide the evidence” or some such nonsense…
So Blog away I’m still not going focus on you. But if our paths cross don’t expect me to treat you with any deference because you have shown your self to be unworthy of my respect.
